Terms & Conditions

1. Scope of application

These General Terms and Conditions (GTC) of SYMEDIC GmbH, Schönhauser Allee 163, 10435 Berlin apply to all contracts for the provision of services in the field of testing.

2. Our services 

We offer testing services especially for the SARS-CoV-2 virus. This includes rapid antigen tests as well as PCR tests. Furthermore, we offer antibody tests.

We exclusively offer self-pay tests and "citizen tests" according to § 4a of the Coronavirus Testing Ordinance.

Although our test sites are managed by physicians, we explicitly do not offer medical services. Our services do not replace medical examinations. 

2.1 Prices

The prices for our services can be found in price quotations on our websites and in notices in the test sites (total prices in each case). 

3. Test procedure and booking

  1. We offer our services in the test stations operated by us. A test can be booked bindingly via the booking portal "Probatix" of Venture Leap GmbH, which you can access via our website. After the booking has been made, you will receive an order confirmation by e-mail, which concludes the contract. 

  2. You can also come to our test center without having previously made a booking online and order a test service on site. 

  3. Please comply with the infection control measures and follow the requirements of the on-site staff. A minimum distance of 1.5 meters from other persons must be maintained at all times. Mouth-to-nose covering must be properly worn at all times unless our staff advises otherwise (e.g., for identification when matching with ID photo as well as, of course, when swabbing).

  4. Please note that we perform an identity check prior to any testing. Please have your ID ready for this. This ensures that our issued certificates are assigned to the correct person. This also ensures that we comply with our obligation to report to the relevant health authorities in accordance with the IfSG. Data protection information can be found here

  5. Payment for chargeable tests can be made either online during booking or on site at the test station. On-site payments are possible with credit & debit cards. Online payments are possible via PayPal and Stripe (card, Apple Pay, Google Pay, Giropay, SEPA). Payment is made in advance. We reserve the right to perform the service only after receipt of payment. 

  6. For a free citizen test, you must select the claim basis, confirm that you are entitled to a free citizen test according to the TestV and provide proof of this claim basis.

5. Disclaimer

  1. Each test evaluation is based on the latest state of the art. However, in very few cases tests may not show the correct result. 100% accuracy can neither be guaranteed by us nor by analysis system manufacturers. The underlying cause may be a poor quality of the sample or a failure of the analysis system due to unforeseeable reasons or reasons for which we are not responsible. In these cases neither the medical management nor SYMEDIC GmbH is responsible for the accuracy of the result. Any liability claims arising from this are excluded, unless they are based on gross negligence or intentional breach of duty. In any case, the exclusion of liability for injury to health, life or limb is also excluded. 

  2. In the case of slight negligence and breach of an essential contractual obligation (cardinal obligation), the liability of SYMEDIC GmbH is also limited to the foreseeable, typically occurring damage. Essential contractual obligations (cardinal obligations) are those whose fulfillment is necessary to achieve the goal of the contract. An exclusion of liability does not apply to claims for damages arising from liability for material defects, which are based on a grossly negligent or intentional breach of duty by SYMEDIC GmbH. In any case, the exclusion of liability is also excluded in the event of injury to health, life or limb. 

6 Cancellation policy for online bookings

6.1 Right of withdrawal for consumers

Consumers have the right to revoke this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the date of conclusion of the contract.

To exercise your right of withdrawal, you must inform us (SYMEDIC GmbH, Schönhauser Allee 163 10435 Berlin, Email: service@SYMEDIC.berlin, Tel: 030 - 555 72 74 22) by means of a clear statement (e.g. a letter sent by mail, fax or e-mail) about your decision to revoke this contract. For this purpose, you may use the enclosed sample revocation form, which, however, is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period.

6.2 Consequences of the revocation

If you revoke this contract, we shall reimburse you for all payments we have received from you without undue delay and at the latest within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment.

If you have requested that the services begin during the withdrawal period, you shall pay us a reasonable amount corresponding to the proportion of the services already provided up to the point in time at which you notify us of the exercise of the right of withdrawal with regard to this contract compared to the total scope of the services provided for in the contract.

 

In addition, the right of withdrawal shall expire if the service is performed in full within the withdrawal period, Section 356 (4) of the German Civil Code (BGB): The right of withdrawal shall also expire in the case of contracts for the provision of services under the following conditions:

  1. in the case of a contract that does not oblige the consumer to pay a price, if the entrepreneur has fully performed the service,

  2. in the case of a contract which obliges the consumer to pay a price, when the service has been provided in full, if the consumer, prior to the commencement of the provision of the service, has

    1. expressly agreed that the entrepreneur begins to provide the service before the expiry of the withdrawal period,

    2. in the case of an off-premises contract, has provided the consent referred to in point (a) on a durable medium, and

    3. has confirmed his knowledge that his right of withdrawal expires upon complete performance of the contract by the Entrepreneur.

7. EU Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS), which can be found at https://ec.europa.eu/consumers/odr.

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

 

8. final provisions

Contracts between the provider and the customers are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods.

Should individual provisions of these GTC be or become invalid in whole or in part, or should these GTC contain gaps, the remaining provisions of these GTC shall remain unaffected and valid. For any existing or arising gaps, the statutory provisions shall apply.
